Description

Decree-Law No. 73/2011, of 17 June, changed the general waste management regime contained in Decree-Law No. 178/2006, of 5 September, simultaneously transposing Parliament's Directive No. 2008/98 / EC European Parliament and the Council of 19 November.
Since 2011, the mandatory use of 5% of recycled materials or incorporating recycled materials in relation to the total amount of raw materials used on the job, in construction and infrastructure maintenance works is provided for, whenever technically feasible. of the Public Contracts Code.
This measure aims to promote the recycling of waste and the use of recycled materials, promote sustainability by reducing the use of natural resources, as well as contribute to the waste recovery targets imposed by the European Union to be achieved in 2020.
In order to evaluate its implementation by the contracting entities, APA, in partnership with the Institute of Public Markets, Real Estate and Construction (IMPIC) developed a form on the Public Contracts Portal (Portal Base) dedicated to this matter, which has been available since the beginning of 2016.
In view of the first results analyzed, it was found that there was an incorrect interpretation of what is required by law, namely in the understanding of what is called “recycled materials or that incorporate recycled materials”.

Outcomes

Results of the project/initiative:
50% of urban waste (paper, cardboard, glass, plastic, etc.) will be re-used and recycled

Impacts/Outcomes 2:
70% of waste will be re-used, recycled or recovered in any other way.

Impacts/Outcomes 3:
whenever technically possible, 5% of the raw materials used in public construction must be recycled materials.
